Terms of Service

Effective October 15, 2026

These terms govern your use of AIFans API (the “Service”), operated by AIFans API (“we”, “us”). Please read them before you sign up, in particular the sections on refunds (3.6), acceptable use (4) and liability (8). By ticking the box at sign-up, creating an account or using the Service you agree to these terms. If you use the Service for an organisation, you confirm that you may bind it to these terms.

1. The Service

  1. The Service is an API platform for developers and businesses: with an API key we issue, you call large language models through interfaces compatible with the OpenAI and Anthropic APIs, and you pay for what you use.
  2. The models, versions, prices and interfaces available are those shown on the Models & pricing pages. We may add, replace, restrict or retire models when model providers change them or for operational or legal reasons, and we will try to announce such changes in the console in advance.
  3. Model output is generated by artificial intelligence. We do not guarantee that output is accurate, complete or fit for any purpose, or that the Service will be uninterrupted or error-free. The Service is provided without a service level agreement.
  4. The Service is not offered in mainland China or in countries and regions subject to comprehensive sanctions, and may not be used from there.

2. Your account

  1. You must be at least 18 years old. You must give a valid email address, verify it, and keep it up to date.
  2. We may review accounts and ask what you use the Service for. We may refuse or limit the Service if you do not cooperate or if we suspect misuse.
  3. Keep your password and API keys secret. Calls made and charges incurred with your account or your API keys are your responsibility. If a key may have leaked, disable it in the console at once and tell us.
  4. Your account is for your own (or your organisation's) use. Do not lend, sell or share your account or API keys.

3. Prices, payment and refunds

  1. The Service is prepaid. Input, cached input and output tokens are charged at the per-token prices shown on the Models & pricing page. Some models have peak and off-peak prices, set by the time a request arrives, as explained on that page. All amounts are in US dollars.
  2. Each request is charged to your balance when it completes. When your balance runs out, requests are refused. Requests that fail on our side are not charged. If a streamed request is cut off by you, the part already generated is charged by actual or estimated usage.
  3. We may change prices. We will announce changes in the console in advance; new prices apply only to usage after they take effect.
  4. You add credit by paying online through PayPal (with a PayPal account or a card), or by bank transfer arranged with us. A payment processing fee shown at checkout is added to each online top-up; the fee is not part of your credit.
  5. Credit does not expire while your account is open. Vouchers, welcome credit and other credit we give you for free are not money you paid: they can be used for the Service only, expire as stated, and are never refunded or exchanged for cash.
  6. Refunds.
    1. You may ask for a refund of credit you paid for and have not used. Used credit is not refundable.
    2. Refunds go back to the original payment method. For online top-ups, you may ask for a refund within 12 months of the payment; after that we will agree another way with you. Payment processing fees are not refunded.
    3. Send refund requests to email [email protected]. We process them within 15 business days after confirming your identity.
    4. This does not affect any right you have under laws that cannot be excluded by contract.
  7. If you dispute a payment with PayPal or your card issuer without first contacting us, we may suspend your account while the dispute is open.

4. Acceptable use

  1. Use the Service lawfully. Do not use it to create or spread illegal content, to harm others, or for fraud, malware, spam, harassment, or content that sexualises minors.
  2. If you build the Service into a product used by others, you are responsible for that product, for your end users, and for meeting the legal obligations that apply to it (for example disclosing that content is AI-generated where the law requires it).
  3. Only submit content you have the right to submit. Do not submit personal data unless you have a lawful basis for it, and do not submit special categories of personal data, payment card data or secrets that you are not allowed to share.
  4. Integration is allowed; resale is not.
    1. Without our written consent you may not resell, distribute, rent or transfer the Service, or give third parties our API keys, your account or access to the API as such (including running a relay, proxy or shared-account service that offers the same or substantially the same API).
    2. You may build the Service into your own products, apps and services to give your end users features of your product, as long as what they get is your product and not a resale of our API.
  5. Do not attack the Service, get around rate limits or security measures, create accounts in bulk, or use the Service's input or output to train or distil models that compete with us or with the model providers.
  6. Do not rely on model output alone for medical, legal, tax, financial or other professional advice. Have qualified people review such use, and tell end users that AI is involved and what its limits are.
  7. We may use automated checks to detect abuse, and block requests or accounts that break these rules.

5. Your content and our software

  1. Your input stays yours. Rights in the output are, as far as the law allows, governed by the terms of the provider of the model you used; we do not guarantee that output does not infringe the rights of others.
  2. We do not use your input or output to train models. To answer your request, your input is sent to the provider that runs the model; see the Privacy Policy.
  3. The Service's software, interfaces and documentation belong to us or our licensors.

6. Changes, suspension and termination

  1. We may interrupt or change the Service for maintenance, changes by model providers, legal requirements or events beyond our control, and will try to give notice.
  2. If you break these terms, misuse the Service, or put its security at risk, we may limit, suspend or end your access and disable your API keys.
  3. You may close your account at any time by contacting us. When an account is closed, unused paid credit is handled under section 3.6.

7. Disclaimer

Except as expressly stated in these terms, the Service is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows.

8. Limitation of liability

  1. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost revenue or lost data.
  2. Our total liability to you for the Service is limited to the fees you actually paid us in the 12 months before the event giving rise to the claim. This does not limit liability that cannot be limited by law.
  3. You will compensate us for claims by third parties that arise from your content, your products or your breach of these terms.

9. Changes to these terms

We may update these terms and will tell you in the console or by email. Changes that are significantly unfavourable to you are announced in advance. If you keep using the Service after a change takes effect, you accept it; if you do not agree, stop using the Service and you may ask for a refund of unused paid credit.

10. Governing law and disputes

These terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising from them that cannot be settled amicably shall be finally resolved by arbitration administered by the Hong Kong International Arbitration Centre, in Hong Kong, in English. This does not take away protection you have under mandatory consumer laws of the country where you live.
